Liability Waiver & Assumption of Risk

1. Assumption of Risk
By participating in any class, workshop, open studio session, or any other activity on the premises of Phase 3 Glass Works, located at 239 Cross Road, Lake Elmore, Vermont ("the Studio"), you voluntarily acknowledge and assume all risks associated with participation, including but not limited to:
- Cuts, lacerations, or puncture wounds from handling glass, tools, or equipment
- Burns or injury from soldering irons, lead came, flux chemicals, or heated materials
- Exposure to lead, flux fumes, glass dust, or other materials used in stained glass work
- Slips, trips, or falls on the studio premises or surrounding property
- Any other injury, illness, or property damage arising from participation in studio activities
You understand that stained glass work involves inherently dangerous materials and tools, and that injuries can occur even when all reasonable precautions are taken.
2. Release of Liability
In consideration of being permitted to participate in activities at Phase 3 Glass Works, you, on behalf of yourself, your heirs, personal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue Kenneth Haggett, Phase 3 Glass Works, their agents, employees, and representatives (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by you while participating in any activity on the Studio premises or traveling to or from such activity, whether caused by the negligence of the Released Parties or otherwise.
3. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from your participation in studio activities, your presence on the Studio premises, or any violation of these terms.
4. Personal Responsibility & Conduct
You agree to follow all safety instructions provided by Ken Haggett or Studio staff at all times. You acknowledge that you are solely responsible for your own conduct and actions while on the Studio premises or property. The Studio reserves the right to ask any participant to leave at any time for safety or conduct reasons without refund.
You agree not to participate while under the influence of alcohol, drugs, or any substance that may impair your judgment or coordination.
5. Minors
Participants under the age of 18 must have a parent or legal guardian sign this waiver on their behalf. By registering a minor for any Studio activity, the parent or guardian assumes all risks and agrees to all terms stated herein on behalf of the minor.
6. Property Damage
You are responsible for any damage you cause to Studio equipment, tools, materials, or property during your participation. The Studio is not responsible for any loss, theft, or damage to your personal belongings while on the premises.
7. Medical Conditions
You represent that you are in good physical health and are not aware of any medical condition that would prevent safe participation in stained glass activities. You acknowledge that the Studio does not provide medical supervision and that you are solely responsible for your own health and safety decisions.
8. Governing Law
This waiver shall be governed by and construed in accordance with the laws of the State of Vermont. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Lamoille County, Vermont.
9. Severability
If any provision of this waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect.
BY REGISTERING FOR ANY CLASS OR ACTIVITY AT PHASE 3 GLASS WORKS, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS WAIVER IN ITS ENTIRETY, UNDERSTAND ITS TERMS, AND AGREE TO BE BOUND BY THEM. YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS BY AGREEING TO THESE TERMS.
